Please read these Terms of Service (“Agreement” or “Terms of Service”) carefully before using http://www.localbushel.com (the “Site”) operated by Local Bushel, Co. (“Local Bushel”, “us”, “we”, or “our”). This Agreement sets forth the legally binding Terms of Service for your use of the Site.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms of Service.

Delivery

Local Bushel has an order minimum of $200. Below $200, we charge a $75 delivery fee. Above $200, delivery of the order is free. Your delivery schedule can be accessed in the “Orders” section of the Site. We need two days to prepare an order, so please place your order two days in advance. For example, if you would like an order to arrive on Wednesday, please place your order before midnight on Monday.

Refund or Exchange

If you want a refund or exchange, call or email us and we will work with you to make things right. Please try to get in touch with us within 24 hours of receiving an order if you need an exchange or refund. We appreciate your feedback and want to you to have an amazing experience with us.

Intellectual Property

The Site and its original content, features and functionality are owned by Local Bushel and protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. Neither the Site nor the Local Bushel service may be reproduced, redistributed, copied, or otherwise exploited for any commercial purpose without express written consent of Local Bushel.

Our Site may contain links to third-party sites that we do not own or control and as such Local Bushel assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. However, we do not represent or warrant that product descriptions or other content on the Site is accurate, complete, reliable, current, or error-free. Local Bushel and it suppliers may make changes (e.g. product offering, pricing, etc.) or improvements to the website at any time.

Limitation of Liability. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE OR ANY SERVICE PROVIDED TO YOU IS TO STOP USING THE SITE OR ANY LOCAL BUSHEL SERVICE.

SOME STATES DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. IN SUCH STATES, OUR LIABILITY AND THAT OF OUR THIRD PARTY CONTENT PROVIDERS WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

Termination

We may terminate your access to the Site or cancel any service, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Governing Law

This Agreement (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of New York, United States, without giving effect to any principles of conflicts of law. Any controversy between the parties arising out of this Agreement shall be submitted to the state or federal courts in New York, NY.

Changes To This Agreement

We reserve the right, at our sole discretion, to modify or replace these Terms of Service by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms of Service.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
